School Board Candidates are Posted

July 3rd was the deadline to file for candidacy for the 2006 Maryland state gubernatorial election. The state has posted all the applicants for all offices, including Montgomery County Board of Education.

Here are the school board candidates. Note that party affiliation is listed on this document, and all candidates listed themselves as "nonpartisan." I am not going to publish home addresses and phone numbers. Those are easily enough obtained if you want them. It is probably useful to see what town they live in, so I am giving that.

In Virginia and DC, various organizations give candidates for office a questionnaire asking their opinion on issues they may address in office related to LGBT people. Is anyone doing that in Montgomery with the school board candidates (e.g. Equality Maryland). Questions could address health curriculum topics, curriculum inclusive of LGBT people (e.g. Stonewall, Harvey Milk, Walt Whitman, Langston Hughes), etc.

It seems that non-partisan tax-exempt nonprofits can do this without losing their 501(c)(3) status.

Personally, I think you should be able to, Robert, but the word coming from the IRS is that if the organization's views are well known and the questionaires address the same topics, they're going to consider it partisan activity.

Really, though, is C3 status any big advantage to TTF? Are you really getting any sizable contributions that are tax-motivated? What is TTF's tax-exempt purpose anyway?

If the IRS is really prohibiting this activity, it will severely limit what a whole host of organizations do. This type of information-gathering activity is very useful to thoughtful voters.

Do you know, by chance, why the IRS is changing these regulations? Does the change come from congress? The White House? Political appointees? Career IRS employees?

Dear Robert,

As it stands now, groups such as ours can ask candidates for information, just as you suggest. We have to ask all qualified candidates the same questions and we have to ask questions that are of interest to the general public.

What's your basis for this, Tish?

The real question is: why does TTF deserve to be subsidized by the American taxpayer?
